Terms of Use

1. Definitions

• Academy: The sports academy or institution subscribing to and using the Platform.
• User: Any individual authorised by an Academy to access and use the Platform, including players, coaches, administrators, and franchisees.
• Services: Modules and features such as player registration, training, events, facilities, finance, merchandising, community, and more.
• Content: Information or materials uploaded, submitted, or generated through the Platform by Users.

2. Eligibility

You must be at least 18 years old to enter into a binding agreement. Users under 18 may access the Platform only with parental or guardian consent. By registering, you confirm that all information provided is true, accurate, and complete.

3. Account Registration & Security

• Each Academy is responsible for managing its account and ensuring authorised Users protect their login credentials.
• Notify us immediately of any unauthorised access or security breach.
• The Academy is responsible for all activities under its account.

4. Services & Usage

• The Platform is subscription-based; features vary by plan.
• We may introduce, modify, or discontinue modules with prior notice.
• Misuse (e.g., reverse engineering, unauthorised access, unlawful activity) is prohibited.

5. Subscription, Fees & Payment

• Fees and payment terms are presented at purchase.
• Refund & Cancellation: Subscriptions are non-refundable except as required by applicable consumer protection laws; promotional trials may be offered.
• Non-payment may lead to suspension or termination.

6. Intellectual Property Rights

The Platform, software, design, trademarks, and Company-provided content remain our property. Users own their Content but grant us a non-exclusive, worldwide, royalty-free licence to host, process, and display such Content solely to provide the Services. Users shall not copy, modify, distribute, or create derivative works of the Platform.

7. User Content & Responsibilities

• Content must not infringe rights, violate laws, or contain harmful material.
• Users are responsible for the accuracy and legality of their Content.
• We may remove Content that violates these Terms.

8. Data Protection & Privacy

• We protect your data per our Privacy Policy and applicable laws.
• India: IT Act 2000, SPDI Rules 2011, and DPDP Act 2023 compliance.
• International: GDPR compliance where applicable.
• Consent mechanisms apply; explicit consent required for sensitive/biometric data.
• Parental consent for users under 18; not for children under 13 without COPPA-compliant measures.
• Cookies/tracking preferences and opt-outs are provided.

9. Confidentiality

Both parties must maintain confidentiality of proprietary or sensitive information, subject to legal disclosure obligations.

10. Community & Communication

Community tools may be moderated. Users must engage respectfully and must not harass, abuse, or act unlawfully.

11. Third-Party Services & Integrations

Third-party services (payment gateways, analytics, etc.) have their own practices; we are not responsible for their content or privacy policies.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Direct liability is limited to the amount paid by the Academy in the preceding 12 months.

13. Indemnification

Users agree to indemnify and hold harmless the Company and its affiliates from claims arising from violations of these Terms, misuse of the Platform, or infringement of third-party rights.

14. Termination

We may suspend or terminate access for violations, non-payment, or unlawful use. Payment, confidentiality, indemnification, and liability limits survive termination.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts in Thiruvananthapuram, Kerala have exclusive jurisdiction.

16. Amendments

We may update these Terms. Posting updates on the Platform constitutes notice; continued use signifies acceptance.
